I have the honor requesting you to please allow me room in your Letters page, to voice my opinion in respect to the matter I have just come across in your electronic dispatch.
It is on whether the ICTR will hand over pending genocide cases to the East African Community Court of Justice.
I would like to point out that the ICTR prosecutors have grossly erred, in their approach to this matter. Referring remaining/pending genocide cases to the East African Community Court of Justice after the ICTR’s extended mandate is over is certainly not consistent with justice.
Its crystal clear that the ICTR’s proposal/intention is a glaring denial of justice. Why are they departing from their previous commitments to hand over pending matters to Rwanda in the first place?
The ICTR prosecutors are well aware of the fact that the EACJ has no tradition whatsoever as a criminal court of justice.
The EAC itself is just a new regional contrivance that has as yet no history as an international organization. Therefore, it’s ridiculous that the idea is even mooted in the first place.
