NYARUGENGE - Nyarugenge commercial court is hearing a case, in which a Kigali business-woman has sued the insurance company, COGEAR over non-payment of her claims.

Jeanne Ndatimana claims that she lost over Rwf10m after her Rwf45m paper cutting machine was damaged while in transit, from Dubai to Kigali. 

"My client received one of her goods damaged, but fortunately she had insured all she was importing to protect her business like any prospecting business person but the insurance company has continued to neglect her pleas for claims,” Ndatimana’s lawyer Clement Ntihemuka told the court.

"My client recognised the damage on the machine on the first day and reported it to her insurer but her claim was turned down.”

Information provided in court indicates that the claimant, ordered goods from Dubai and transported them to Kigali through a transport company identified as JACAJU and the paper cutting machine in question was damaged before reaching its destination.

Ndatimana operates a stationery business in Kigali. 
Her lawyer has requested the court to order the insurance company to pay over Rwf 10 million which includes repairs to the machine and losses incurred since February 2007. 

"The machine has the capacity to generate Rwf 10,000 per hour, and it can work 24 hours. Depending on business, it is at least estimated that my claimant loses Rwf30, 000 per day on average,” the lawyer emphasised in the court.

COGEAR’s lawyer, John Bosco Kazungu blames the transporters saying they should have taken precaution  while transporting the machine.

COGEAR contests the claimant’s position arguing that her claims can’t be taken serious since they weren’t verified by a trusted valuator.   

Ntihemuka told The New Times outside the court room that the evaluation was done by a trusted agency called Kigali LLOYD’s Agency.Verdict for this case has been scheduled for September 30.
